Someone seeking a domestic violence restraining order must confirm with the Court that they are or were in a qualifying relationship, as required by the Domestic Violence Prevention Act. If the requesting party is or was in any of the following relationships with the person they wish to restrain, they qualify for a restraining order in family court: a dating relationship, married spouses, having a child together but not otherwise married or dating, parent-child, other family members, or siblings.

Our firm assists clients to through the entire process of filing a request for a domestic violence restraining order with the court. A restraining order is often filed on an emergency basis with an extremely short window. Parties needing protection must complete requisite forms identifying their requests to the Court, draft a written declaration informing the judge of the abuse they've endured, and provide evidence to support the allegations in their declaration. Once submitted to the Court for processing, the moving party should receive a response ( that their restraining order as granted in full, granted in part, or denied) from the court within 48 hours, at which time a court appearance will be scheduled.
